Terms and Conditions
Welcome to Solisla. These Terms and Conditions ("Terms") govern your access to and use of the Solisla website, application, and services (collectively, the "Platform"), operated by Solisla ("Solisla," "we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Eligibility and Age Verification
You must be at least 18 years of age to create an account or use the Platform. By creating an account, you are required to confirm that you are at least 18 years old by affirmatively checking the age verification box during the registration process. This confirmation constitutes your representation and warranty that you meet the minimum age requirement and have the legal capacity to enter into these Terms. If Solisla discovers or reasonably believes that a user is under 18 years of age, we reserve the right to immediately suspend or terminate that user's account and remove any content they have submitted.
2. Account Registration
To submit reviews or interact with certain features of the Platform, you must create an account by providing a valid email address, a password, and a public display name ("username").
- Your username is publicly visible on the Platform. You are responsible for choosing a username that does not contain your real name, email address, phone number, or other personally identifiable information. Solisla is not responsible for any personal information you voluntarily include in your username.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You may not create multiple accounts for the purpose of submitting duplicate reviews, manipulating ratings, or circumventing any restriction imposed by Solisla.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. User-Generated Content and Reviews
The Platform allows registered users to submit written reviews and star ratings for residential rental properties ("Reviews"). By submitting a Review, you agree to the following:
3.1 Truthfulness and Personal Experience
All Reviews must be based on your genuine, firsthand experience as a tenant at the reviewed property. You must have personally rented or occupied the property you are reviewing. Reviews based on secondhand information, speculation, or fabrication are prohibited.
3.2 Prohibited Content
You may not submit Reviews or other content that:
- Contains knowingly false statements of fact about a property, landlord, or property manager
- Includes personal identifying information about any individual, including but not limited to full names, phone numbers, email addresses, or physical descriptions of landlords or property managers beyond their professional capacity
- Contains hate speech, threats, harassment, discriminatory language, or content that targets any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Includes profanity, obscenity, or sexually explicit material
- Promotes or encourages illegal activity
- Is intended to manipulate or artificially inflate or deflate the rating of any property
- Contains advertising, spam, or promotional material unrelated to the rental experience
- Infringes on any third party's intellectual property, privacy, or other rights
3.3 Anonymity
Reviews are displayed publicly under your chosen username. Solisla does not publicly display your email address, real name, or other account information alongside your Reviews. However, anonymity does not exempt you from legal responsibility for the content of your Reviews.
3.4 Rental Timeframe
When submitting a Review, you will be asked to indicate when you rented the property. This information is displayed publicly alongside your Review to provide context to other users. You agree to select the timeframe that most accurately reflects your tenancy.
3.5 License to Your Content
By submitting a Review or other content to the Platform, you grant Solisla a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, distribute, and create derivative works from your content in connection with operating, promoting, and improving the Platform. You retain ownership of your content, but this license allows us to display and use it as part of the Platform's services, including potential data partnerships with third-party platforms.
3.6 No Compensation for Reviews
Solisla does not offer and will never offer monetary compensation, gift cards, discounts, or any other financial incentive in exchange for submitting a Review. Reviews must reflect genuine, uncompensated opinions.
4. Review Flagging and Content Moderation
4.1 Flagging Reviews
Registered users may flag Reviews they believe violate these Terms. When flagging a Review, users must select a reason for the flag and may provide additional context. Flagging a Review does not guarantee its removal.
4.2 Review Process
Solisla reviews all flagged content and makes moderation decisions at its sole discretion, based on these Terms and our Content Policy. We are under no obligation to remove a Review simply because it has been flagged or because a property owner or manager disagrees with its content.
4.3 Negative Reviews Are Not Grounds for Removal
A Review that is negative, critical, or unfavorable to a property, landlord, or property manager is not, by itself, grounds for removal. Solisla does not remove Reviews solely because they are negative, so long as they reflect the genuine personal experience of the reviewer and do not contain prohibited content as defined in Section 3.2.
4.4 Consequences of Abuse
Users who repeatedly submit bad-faith flags, submit Reviews that violate these Terms, or engage in coordinated efforts to manipulate ratings may have their accounts suspended or permanently terminated.
5. Renter Verification
5.1 Optional Verification
Users may optionally verify their Reviews by uploading documentation that demonstrates they resided at the reviewed property. Accepted documents include lease agreements, utility bills, renter's insurance policies, or other official documents showing the user's name at the property address.
5.2 Document Handling and Privacy
Verification documents are uploaded to a secure, private storage system accessible only to authorized Solisla administrators. Documents are reviewed solely for the purpose of confirming whether the reviewer resided at the property in question. All verification documents are permanently deleted immediately after a verification decision (approval or rejection) has been made. Solisla does not retain, copy, share, or archive verification documents beyond the time necessary to make a verification decision.
5.3 What We Retain After Verification
After a verification document is reviewed and deleted, the only information retained is: (a) whether the Review was verified or not (a boolean status), (b) the date and time of the verification decision, and (c) the number of verification attempts made. No document content, metadata, file names, or personal information extracted from the document is retained.
5.4 Verification Attempts
Users may attempt to verify a Review up to three (3) times. If a verification is rejected, the user may upload a different document for re-review. After three unsuccessful attempts, the verification option is no longer available for that specific Review. The Review remains on the Platform in its unverified state.
5.5 Verification Does Not Constitute Endorsement
A "Verified Renter" badge indicates only that the reviewer has provided documentation suggesting they resided at the reviewed property. It does not constitute Solisla's endorsement of the Review's accuracy, completeness, or opinions expressed.
6. Properties and Addresses
6.1 User-Submitted Properties
Registered users may add properties to the Platform by providing an address and basic property information. Solisla may supplement user-submitted property information with data from third-party property data providers.
6.2 Accuracy of Property Information
While Solisla endeavors to provide accurate property information, we do not guarantee the accuracy, completeness, or currency of any property data displayed on the Platform, whether submitted by users or sourced from third-party providers.
7. Intellectual Property
7.1 Platform Ownership
The Platform, including its design, features, functionality, branding, logos, and original content, is owned by Solisla and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
7.2 Trademarks
"Solisla" and associated logos are trademarks of Solisla. You may not use our trademarks without prior written permission.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the Platform, you consent to the practices described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
9. Disclaimers
9.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 No Guarantee of Review Accuracy
Solisla does not verify the accuracy of unverified Reviews and makes no representations or warranties regarding the truthfulness, reliability, or completeness of any user-submitted content. Even verified Reviews reflect the personal experience and opinions of individual users and should not be relied upon as the sole basis for any rental decision.
9.3 No Landlord or Property Manager Endorsement
The presence of a property on the Platform does not constitute an endorsement, recommendation, or referral by Solisla of any property, landlord, or property manager.
9.4 No Legal, Financial, or Real Estate Advice
Nothing on the Platform constitutes legal, financial, or real estate advice. Users should conduct their own due diligence and consult qualified professionals before making rental decisions.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Solisla, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform, any user-generated content, or any rental decision made based on information found on the Platform.
Our total aggregate liability for any claims arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the amount you paid to Solisla, if any, in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Solisla, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Platform, (b) any content you submit, including Reviews, (c) your violation of these Terms, or (d) your violation of any rights of any third party.
12. Dispute Resolution
12.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at admin@solisla.co and attempt to resolve the dispute informally for at least thirty (30) days.
12.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Hawaii, unless otherwise agreed by the parties.
12.3 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Solisla.
13. Termination
Solisla may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Reviews you have submitted prior to termination may remain on the Platform at Solisla's discretion. Sections 3.5, 9, 10, 11, and 12 survive termination.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform prior to the changes taking effect. Your continued use of the Platform after updated Terms are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law principles.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Solisla regarding your use of the Platform and supersede any prior agreements or understandings.
